Service Agreement

1. DISCLAIMER

1.1 Tech Device Repair ("TDR") provides repair, upgrade, and referral services solely at our discretion. We strive to deliver high-quality services; however, results are never guaranteed due to the complexity and variability of devices, components, and conditions.
1.2 All services, including repair, diagnostic, and upgrade, are provided "as is" without any warranties—whether express or implied. Old or obsolete parts may render certain repairs impossible.
1.3 Estimated timelines for services are approximate and subject to change.
1.4 You are solely responsible for backing up all device data prior to service. TDR is not liable for any loss, corruption, or compromise of data under any circumstance.
1.5 By submitting your device, you consent to any necessary software installations, tests, or configurations needed to facilitate services.

2. BILLING TERMS

2.1 All service charges are non-negotiable. Quotes provided are estimates, not binding commitments, and may be adjusted if unforeseen complications arise.
2.2 We do not guarantee on-site services. If on-site service is not possible, you are responsible for delivering your device to our facility.
2.3 TDR reserves the right to adjust service costs if hidden or additional problems become apparent during diagnosis or repair.
2.4 If we cannot reach you regarding approvals or necessary updates, we may halt or postpone services until communication is restored.

3. PAYMENT TERMS

3.1 Payment is due in full immediately upon completion of services. Failure to pay will result in any and all legal remedies available, including but not limited to collection efforts, civil action, and full prosecution of returned or dishonored checks.

4. LIABILITY

4.1 All services are performed at your sole risk. TDR, its affiliates, and employees assume zero liability for direct, indirect, incidental, consequential, or any other form of damages, including but not limited to data loss, revenue loss, device malfunction, or personal injury.
4.2 We are not responsible for any existing or underlying damage (e.g., viruses, hardware failure, water damage) discovered during or after our service.
4.3 You agree that any device, and/or content therein, may be documented through photographs, videos, or other media for marketing, educational, or promotional purposes. You release and hold harmless TDR from any claims related to the exposure of personal data, images, or sensitive information.

5. SUPPORT

5.1 TDR provides limited support for completed services. This support may be terminated at our discretion 7 days after service completion, with no obligation to continue support beyond that period.
5.2 Communication regarding updates, promotions, or support may occur via email, SMS, or other channels at our discretion.

6. REPAIRS & SERVICE GUARANTEE

6.1 Repair work includes a two-year warranty on labor (workmanship) and a 60-day warranty on parts. This warranty covers only the specific issue repaired. If misdiagnosis occurs, TDR will waive related labor costs, but parts remain chargeable.
6.2 Warranty does not cover new failures unrelated to the original repair, nor does it extend to other devices or components.

7. COMMUNICATION & MARKETING CONSENT

7.1 By engaging TDR, you explicitly consent to receive marketing, promotional materials, and newsletters. This is a non-negotiable condition for service. You may request removal from our marketing lists at any time after the initial enrollment.

8. ESTIMATES

8.1 All estimates provided are for your reference. TDR makes no commitment to honor these estimates if the actual repair scope differs from the initial assessment.

9. RETURNS

9.1 All sales and services are final. TDR does not accept returns or issue refunds under any circumstances once service is completed and/or the product has been delivered.

10. WARRANTY

10.1 Warranties apply only to the original repair scope and parts. This warranty does not extend to full device replacements or any subsequent issues, whether related or not.

11. INDEMNIFICATION & RELEASE

11.1 To the fullest extent allowed by law, you agree to indemnify, defend, and hold harmless TDR, including our affiliates, officers, employees, and contractors, from any claims, damages, or liabilities arising from your use of our services, any breach of this Agreement, or any act or omission by you.
11.2 You agree to release TDR from any and all claims you may have, known or unknown, arising out of or in connection with any services performed or any use of your device. If you are a California resident, you waive California Civil Code §1542 (and any similar law), which states that a general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement.

By proceeding with Tech Device Repair services, you acknowledge that you have read, understand, and agree to be bound by the terms of this Service Agreement in its entirety.
